JUSTICE RAJESH KUMAR VERMA ORAL ORDER 01-08-2025 Heard Mr. Binod Kumar Mishra, learned counsel for the petitioner and Mr. Mritunjay Kumar Nirala, learned Additional Public Prosecutor for the State.

2. Petitioner seeks bail who is in custody since 03.11.2024 in connection with Chandi P.S. Case No. 565 of 2024, F.I.R. dated 14.10.2024 for the offences punishable under Sections 80(2) and 238(C) of the Bhartiya Nyaya Sanhita, 2023.

3. According to prosecution case, this petitioner along with other accused persons killed the daughter of the informant who happens to be wife of the petitioner due to non-fullfilment of demand of Rs. 2 lakhs, motorcycle and gold jewellery.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case merely on the ground that the

Patna High Court CR. MISC. No.16895 of 2025(5) dt.01-08-2025 2/2 petitioner is husband of the deceased. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.

5. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that the cause of death as mentioned in the postmortem report suggest that number of ante-mortem injuries were found on the body of the deceased and apart from that number of witnesses have supported the case of the prosecution.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Chandi P.S. Case No. 565 of 2024 pending in the court of learned Additional Chief Judicial Magistrate-I, Hilsa (Nalanda)/Court below.

7. Prayer is refused.
