JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Muffasil P.S. Case No. 175 of 2013 registered for the offences punishable under Sections 147, 148, 149, 114, 332, 353, 307, 379, 225, 201, 323 of the Indian Penal Code and Sections 25(1-A), 25 (1-AA), 25(1-b)AC, 26 (i) (ii) and 35 of the Arms Act. Allegedly, during raid seven persons engaged in manufacturing firearms were arrested but thereafter, villagers by forming an unlawful assembly attacked on the Police party and got freed five accused persons and the petitioners are the members of the mob.

Patna High Court Cr.Misc. No.30892 of 2014 (2) dt.22-01-2015 Submission is that in this case Md. Helal and Md. Bholu Mallik have been allowed pre-arrest bail vide order dated 29.4.2014 passed in Cr. Misc. No. 9326 of 2014 and the petitioners have also got no criminal antecedent. In the facts and circumstances stated above, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 175 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
