The petitioner seeks bail in connection with Akabarnagar P.S.Case No.16 of 2017, G.R.No.984 of 2017, registered for offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and Section 3(1)(x) of SC/ST Act.
Allegation against the appellant and other co-accused persons is of assault to the informant.
Submission of the learned counsel for the appellant is that there is nothing specific against the appellant and there is general allegation against three accused persons including the appellant of assault by 'lathi' and 'danda' and nothing has been mentioned about the injuries in the impugned order.
Patna High Court CR. APP (SJ) No.2211 of 2017 (2) dt.21-08-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that he has caused serious injury to the informant.
Having heard both sides and in view of the facts and circumstances, this appeal is disposed of with a direction to the learned court below to examine nature of the injuries on the person of the injured and if the injuries are simple in nature, he shall be released on bail in connection with Akabarnagar P.S.Case No.16 of 2017, G.R.No.984 of 2017, District- Bhagalpur to the satisfaction of Additional District and Sessions Judge-II-cumSpecial Judge, Bhagalpur otherwise he is free to pass any other order or orders as he deems fit and proper.
