The petitioner apprehends his arrest in Aurangabad (Town) P.S. Case No.97/2018 registered under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153(A), 295(A) and 379 of the Indian Penal Code.
The informant Labour Enforcement Officer alleged that on the eve of Ramnavmi, the members of Muslim community started pelting stones on the procession and both sides entered into scuffle. They ransacked the entire market.
Learned counsel for the petitioner submits that no person of either side sustained injury. The petitioner is of course named in the F.I.R. along with many other persons but most of the
Patna High Court Cr.Misc. No.34680 of 2018 (2) dt.03-07-2018 2/2 accused persons have been granted either anticipatory bail or regular bail, who were apprehended on the spot. The case of the petitioner stands on same footing. Similarly situated accused Gaurav Chauhan, Prabhu Dayal @ Gupta @ Prabhu Saw, Naween Kumar Sinha, Kavi Kumar were also granted anticipatory bail. Having considered the aforesaid fact and the nature of allegation made against the petitioner and the fact that similarly situated co-accused persons have been granted anticipatory bail, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Aurangabad (Town) P.S. Case No.97/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
