JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
It is alleged that the complainant paid Rs.44,400/- to the petitioner for depositing it in certain scheme of Sahara India but the petitioner deposited only Rs.6300/-.
Notices were issued to the complainant vide order dated 14.1.2015 but inspite of valid service of notice, no one is appearing on behalf of the complainant.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.29715 of 2014 (3) dt.18-03-2015 2/2 the petitioner filed Aurangabad SC/ST P.S. Case No. 26 of 2013 on 10.6.2013 against the informant making accusation under sections 341,323,379 and 504/34 IPC and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act thereafter the present complaint has been filed on 15.6.2013 and there is no proof with regard to payment. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Complaint Case No. 531 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
