The petitioner is languishing in custody since 2.9.2018 in a case registered for the offences punishable under Sections 399 and 402 of the I.P.C. and Sections 25(1-B) a, 26 and 35 of the Arms Act.

The prosecution case is that on the information received that some miscreants are committing dacoity, a raid was laid when the petitioner and co-accused Md. Faiyaz were arrested. It is further alleged that from the possession of the petitioner, one loaded pistol and four cartridges were recovered. It is submitted by learned counsel for the petitioner that petitioner is not having any criminal antecedent. Statement to that effect has been made in paragraph 3 of the petition. The investigation has already been concluded.

Patna High Court CR. MISC. No.16203 of 2019(2) dt.15-03-2019 2/2 Learned APP submits that recovery has been made from the petitioner.

Considering the fact that investigation has already been concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Bihar P.S.
