JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 30.3.2018, seeks bail in Kotwali PS Case No. 402 of 2016 registered under Section 420 of the IPC, Section 63 of the Copy Right Act and Sections 103/104 of Trade Mark Act.

The allegation in brief is that the petitioner was misusing the trade mark of Godrej company while selling fake products. Learned Counsel for the petitioner submits there is no recovery of any so called fake product of Godrej and another case was also instituted against the petitioner for not allowing the officials to conduct raid, however in that case the petitioner has been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 36718 of 2017, the petitioner has been in custody since 30.3.2017 and bears clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Vikram Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gaya in connection with Kotwali PS Case No. 402 of 2016.
