Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioners apprehend their arrest in connection with Sultanganj P. S. Case No. 54 of 2020 registered for the offences punishable under Sections 341, 323, 359, 384, 385, 387, 504, 506 and 34 of the Indian Penal Code. It has been submitted by the learned counsel for the petitioners that Title Suit and Miscellaneous Case is also pending with regard to the land and pond which was being dug by the informant though on the instruction of the Government
Patna High Court CR. MISC. No.26435 of 2021(2) dt.10-03-2022 2/2 on this, the petitioners protested and this case is the result of this protest.
There is no chance of the absconding of the petitioners and the petitioners have clean antecedent. Considering the facts and circumstances, the present anticipatory bail application is allowed.
Accordingly, let the petitioners, above named, be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/ (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P. S. Case No. 54 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) shakir/- U T
