The petitioner seeks bail in Samastipur Muffasil P.S. Case No. 249/2017, registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-b)/26/35 of the Arms Act.

The case of the prosecution is that in course of checking the vehicle, the petitioner along with two persons was apprehended and a mobile phone is said to have been recovered from the possession of the petitioner. However, the bike and firearm were recovered from possession of other two accused persons.

Learned counsel for the petitioner submits that the petitioner has a clean antecedent. He has been falsely implicated in the present case and he is in custody since 07.05.2017.
