The petitioner is in custody since 07.02.2017 in connection with a case registered for the offences punishable under Sections 414/353/307/34 of the Indian Penal Code and Section 25(1B) A, 26, 27 and 35 of the Arms Act. Learned counsel for the petitioner submits that on the basis of the confessional statement made before the police by one coaccused Lakshman Roy@ Ram Lakshman Roy, the petitioner's name has been brought in connection with the present case. Learned counsel for the petitioner further submits that on the basis of such statement made before the police, the petitioner cannot be prosecuted.

Having considered the entire facts and circumstances of the case and also the period of custody undergone, let the
