JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner. No one appears for the State.

The petitioner, in the present case, is seeking regular bail in connection with Raghopur P.S. Case No.128 of 2017, registered for offences alleged under Sections 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that although in the First Information Report there are general allegations against all the accused persons that they had enticed the daughter of the informant and had taken away with an intention to marry, but later on when the girl herself came back she disclosed in her statement under Section 164 Cr.P.C., which is Annexure-2 to the present application, that she had gone with one

Patna High Court Cr.Misc. No.44361 of 2017 (2) dt.19-09-2017 Santosh Kumar and had solemnized marriage with him. The girl also expressed her desire that she would like to go to her Sasural. Thus, learned counsel submits that so far as the present petitioner is concerned, he is innocent and he has nothing to do with this occurrence but because he happens to be the distant relation of the boy he has been falsely implicated in the present case. In the facts and circumstances of the case, let the petitioner, namely, Shanichar Sah be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, District-Supaul in connection with Raghopur P.S. Case No.128 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
