JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 27.07.2017 passed in Cr. Misc. No. 25637 of 2017 with an observation to conclude the trial within a period of nine months.
Submission of learned counsel for the petitioner is that the period of nine months has already expired and uptill now charge has not been framed. Further submission is that the petitioner is in custody for more than one and a half years and there is no direct evidence against the petitioner of causing death of the deceased and only allegation is that he has thrown the cloth of the deceased and fled away.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.34232 of 2018 (2) dt.22-06-2018 2/2 circumstances, as stated above, considering the period of custody and petitioner is in custody for more than one year, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-V, Siwan, in connection with Sessions Trial No. 571 of 2017 arising out of Siwan Town P.S. Case No. 693 of 2016, on the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition that the petitioner shall co-operate in disposal of the trial.
