The petitioner is apprehending arrest in a case registered for the offences punishable under sections 302,341,323,307,379,504 and 506/34 of the Indian Penal Code. It is alleged that the nephew of the informant was surrounded by the petitioner and co accused Hiraman Paswan and Shivraj Paswan. On protest being made for abusing, the accused persons started assaulting him. It is specifically alleged that Hiraman Paswan assaulted with lathi on head when co accused Shivraj Paswan snatched rupees twenty six thousand and the petitioner snatched wrist watch.

Patna High Court Cr.Misc. No.23695 of 2015 (2) dt.07-07-2015 2/2 It is submitted by learned counsel for the petitioner that specific accusation of assault is against co accused Hiraman Paswan.

Considering the nature of accusation and the fact that the victim succumbed to the injury after ten days of the occurrence, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Ghorasahan P.S. Case No. 385 of 2014 pending in the court of learned J.M. Ist Class, Sikrahana, Motihari.

This application is disposed of with the aforesaid observation/direction.
