JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-06-2020 The petitioner seeks bail in anticipation of his arrest in connection with Cheriya Bariyarpur P. S. Case No. 180 of 2019 dated 01.12.2019 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that 1089 litres of liquor is said to have recovered from a pick-up van. The petitioner admits himself to be the owner of the vehicle. However, the vehicle was given to one Rahul Kumar for transporting husk but without the knowledge of the petitioner, liquor was transported in his vehicle.

The petitioner has clean antecedents.

No.14927 of 2020(2) dt.11-06-2020 2/2 Considering the aforesaid aspects of the matter, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge, Excise Act, Begusarai in connection with Cheriya Bariyarpur P. S. Case No. 180 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
