The petitioner apprehends his arrest in Halsi P.S.Case No. 84/2014 for the offence allegedly committed under sections 409 and 420 of the Indian Penal Code.

The prosecution case is that F.I.R. was lodged at the behest of one Nasimuddin Ahmad, the then Block Education Officer, Ramgrah Chowk. As per F.I.R., it is alleged that at the relevant time, the petitioner was the in-charge Headmaster and Block Teacher of Upgraded Middle School, Gulani, and fund of Rs. 32, 8000/- was allotted for construction of the room of the school but the petitioner mis-appropriated the said amount.

Learned counsel for the petitioner submitted that he has spent certain amounts in the construction of the school building and the rest mount is lying in the account of school fund. Since the investigation has not yet been completed and the final accountee has not been made, so far as it also does not appear from the case diary.

under such circumstances, it is directed that in the event of arrest or surrender within a period of four weeks from today, the above named petitioner Ranjeet Ravidas shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Lakhisarai in Halsi P. S. Case No. 84/2014, subject to condition as laid down under Section 438 (2) of Cr. P. C.
