JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 504, 494, 120B of the Indian Penal Code.
The prosecution case is that the informant got married with the petitioner in 2010 and thereafter torture was inflicted for non-fulfilment of dowry demand and subsequently the petitioner performed second marriage with Nibha Devi.
It is submitted by learned counsel for the petitioner that informant eloped with one Suraj Mandal for which the father of the informant lodged Bermo P.S. Case No. 10 of 2014 registered under Sections 366A/34 of the Indian Penal Code but subsequently the informant entered into compromise with Suraj Mandal, as a result he got acquitted by Juvenile Justice Board, Bokaro vide judgment dated
Patna High Court Cr.Misc. No.19599 of 2016 (2) dt.03-05-2016 2/2 27.11.2015.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui in connection with Sikandra P.S. Case No. 157 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
