JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and State. The petitioner is accused in Mirganj P.S.Case No. 101 of 2016 for the offences under Sections 395, 412 and 414 of the Indian Penal Code and Section 25(1-A)26 (ii) and 35 of the Arms Act.
The submission of counsel for the petitioner is that the petitioner is in custody since 13.12.2016 on the basis of confessional statement of co-accused. He submits that the manner in which the FIR was lodged and the seizure list prepared in this case creates serious doubt about the authenticity about the manner of the occurrence. He also submits that similarly circumstanced co-accused Binod Yadav has been granted bail by
Patna High Court Cr.Misc. No.37788 of 2017 (2) dt.19-08-2017 2/2 this Court in Cr. Misc. No. 37373 of 2017 vide order dated 7.8.2017.
Having regard to the fact that the petitioner is in custody since 13.12.2016 and similarly circumstanced co-accused Binod Yadav has been granted bail by this Court Cr. Misc. No. 37373 of 2017 vide order dated 7.8.2017, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj or the successor Court in connection with Mirganj P.S. Case No. 101/2016, subject to the condition that the bailors should be close relative of the petitioner and the petitioner will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
