JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 427, 504, 506 of the Indian Penal Code and under Sections 3 (1) (x) of the SC and ST (Prevention of Atrocities) Act. The prosecution case is that the accused persons assaulted the informant and abused her by calling her caste name. It is submitted by the learned counsel for the petitioners that the petitioners have been falsely implicated in the present case. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the nature of accusation, let the learned
Patna High Court Cr.Misc. No.19769 of 2016 (2) dt.04-05-2016 2/2 court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Bhagwanpur Hat P.S. case No. 119 of 2015 pending in the court of learned A.C.J.M., X, Siwan. The learned court below shall dispose of the bail petition of petitioners, preferably, on the same day.
This application is disposed of with the aforesaid observation/direction.
