The petitioner apprehends his arrest in Bettiah Town P.S. case No. 431 of 2018 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The police raided the house of Amarnath Ram and recovered two liters of country made liquor.

The learned counsel for the petitioner submits that petitioner is brother of Amarnath Ram. Amarnath Ram was arrested for recovery of two liters of country made liquor from his house. The petitioner has been made accused only because he happens to be brother of Amarnath Ram. Nothing has been recovered from the house/ room of the petitioner. It is submitted that from perusal of seizure list, it would appear that place of

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Bettiah, West Champaran in connection with Bettiah Town P.S. case No. 431 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
