The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on a raid being conducted two accused namely Siku Mehta and the petitioner herein were caught and it is stated that from the house of the co-accused 306 litres of IMFL was recovered.
From perusal of the bail petition it transpires that the case of the petitioner is that of his being falsely implicated in the case. No incriminating article has been recovered from the possession of the petitioner who is in custody since 21.1.2021
Patna High Court CR. MISC. No.26722 of 2021(2) dt.08-12-2021 2/2 and has no criminal antecedent.
Heard learned APP for the State.
Having heard learned APP for the State and on having perused the materials on record, taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and being in custody for 10 months, the Court directs the petitioner to be enlarged on bail in connection with Patahi P.S. Case no. 17 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, East Champaran at Motihari.
