JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 This is an application for grant of anticipatory bail in connection with Mithanpura P.S. Case No. 126 of 2018, disclosing offences under Sections 409, 120(B) of the Indian Penal Code.

Allegation against the petitioners, who are the Transporter, that they got a tender for supply of bitumen and lifted the same for delivery to the Broadway Link Ltd., but due to some mechanical defects in the truck, they could not supply the same.

Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a direction to the petitioners to surrender before the learned court below and on surrender they will be released on provisional bail with condition that the receiving given by the Broadway Link Ltd. shall be verified by the court concerned from the informant of this case and on being satisfied, the learned court below shall confirm the provisional bail of the petitioners.
