The petitioner seeks bail in connection with Arwal Mahila P.S. Case No. 07 of 2018 registered for the offences punishable under Sections 376 and 506 of the Indian Penal Code and Section 4 of the POCSO Act.
Allegation made by the informant Parwati Devi alleging therein that in the afternoon of 20.05.2018, her minor daughter aged about 13 years was subjected to rape by this accused in her home itself. In the meanwhile, her other younger Sunni Kumari went into and saw the act raised hulla. When informant reached there accused while fleeing threatened her not to disclose the matter otherwise she would be killed. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case due to

No occurrence is alleged took place but with ulterior motive malafide intention and to extor money, petitioner has been dragged in this case without any rhyme and reason. There is previous land dispute due to drainage and petitioner is in jail custody since 18.09.2019.
Learned A.P.P. for the State has opposed the prayer for bail and submits that the petitioner is named in the F.I.R. There is direct allegation of rape against the petitioner on minor victim.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner in connection with Arwal Mahila P.S. Case No.07 of 2018 is hereby rejected at present. (Anjani Kumar Sharan, J) Nasimul/- U T
