JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 71C of 2011 for the offence under Sections 406 and 420 of the Indian Penal Code. Heard learned counsel for the petitioner, learned counsel for the complainant and the State.

The prosecution story, in brief, is that the complainant deposited Rs. 11,74,619/- in the S.B.I. Branch Aliganj. It is alleged that by forgery Rs. 10,00,000/- has been transferred in favour of the petitioner. After repeated demand no money has been returned to the complainant by the petitioner.

It is submitted on behalf of the petitioner that petitioner has been made accused due to mistake of fact. In fact, no fault or cheating has been made on the part of the

Patna High Court Cr.Misc. No.25970 of 2015 (2) dt.16-07-2015 petitioner. It is further submitted on behalf of the petitioner that the petitioner is ready to deposit an amount of Rs. 25,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State and complainant, it has been submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sheikhpura in connection with Complaint Case No. 71C of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.

It is further directed that the petitioner shall deposit an amount of Rs. 25,000/- before the court below and the same will be subject to final disposal of the case. (Sudhir Singh, J) P.K./- U T
