JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-08-2015 In the present appeal, the appellants have challenged the judgment dated 04.12.2014 passed by the learned 6th Additional District & Sessions Judge, West Champaran at Bettiah in Sessions Trial No. 482 of 2010 arising out of Yogapatti P.S.Case No. 217 of 2002, by which the appellants have been convicted under sections 323 and 447 of the Indian Penal Code and thereafter released under section 3 of the Probation of Offenders Act, 1958 and a direction has been made to make payment of Rs.25,000/- by each of the convict to the informant Kashi Thakur as compensation.
It is submitted by the learned counsel for the appellants that there is no prayer of bail in the present memo of
Patna High Court CR. APP (SJ) No.251 of 2015 (5) dt.20-08-2015 2/2 appeal and in the order dated 09.07.2015 it has wrongly been recorded that the prayer for bail of the appellants shall be considered after receipt of the lower court records. It is further contended by the learned counsel for the appellants that he has instructions from his clients not to press the memo of appeal. In that view of the matter, the instant appeal is dismissed as not pressed.
