JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 1407 of 2016, disclosing offences under Sections 323, 341, 342 and 498(A) of the Indian Penal Code.
Petitioner happens to be husband of the complainant and allegation against him is of subjecting the complainant to torture and assault with respect to demand of hero honda motorcycle as dowry and ultimately he ousted her from the house. On appearance of opposite party no. 2, earlier the matter was referred to Patna High Court Mediation and Conciliation Centre, Patna vide order dated 21.05.2019 and the learned Mediator has submitted his report stating that the dispute between
Patna High Court CR. MISC. No.15647 of 2019(4) dt.05-08-2019 2/2 the parties has been resolved through the process of Mediation. Learned counsel for both the parties have appeared and submitted that now the petitioner and complainant are living together and living their peaceful and happy life. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, surrender in the court below on 14.08.2019, on which, the court below shall release him on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, West Muzaffarpur, in connection with Complaint Case No. 1407 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is further subject to the condition that both the parties shall abide by the terms and conditions agreed upon by them.
