The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 439.5 litres of liquor was recovered from a car and two accused persons were taken into custody. It is further stated that the two accused took the name of the petitioner as being partner in the business of liquor. It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article was recovered from his possession. He has been falsely implicated in the case. He is in custody since

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no.103 of 2021 (arising out of Ramgarh P.S. Case no.27 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd -cumSpecial Judge, Excise, Kaimur at Bhabua.
