The petitioner was appointed as a doctor in the Zila Parishad, Motihari on 1.11.1995. It is submitted that he superannuated on 28.2.2011. Though the contemporary members were being paid Rs. 2000 to 3800, whereas the petitioner has been paid only Rs. 1000-1850. On account of such disparity, the petitioner has made a claim for arrears of salary before respondent no.4.

Various representations filed by the petitioner also show that he has also claimed grant of Rs.5.13 lacs on account of earned leave. Representations of the petitioner have still not been decided by the respondent no.4.

Patna High Court CWJC No.11941 of 2014(2) dt.25-02-2019 2/2 In view of the aforesaid situation, without expressing any opinion on the merits of the claim made by the petitioner, writ petition is disposed of with a direction to respondent no.4 to consider the petitioner's claim and pass a reasoned and speaking order within a period of three months from the date of receipt/production of a copy of this order.

Writ petition is disposed of.
