JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2017 The petitioner seeks regular bail in connection with Laxamipur (Gidhaur) P.S. Case No. 179 of 2015, registered for offences punishable under Sections 302/34 of Indian Penal Code. Allegation against the petitioner is of killing the husband of the informant.

It has been submitted by learned counsel for the petitioner that he has falsely been implicated in this case and it is apparent from the F.I.R itself that the deceased was sleeping in drunken condition outside the house and there might be some other reasons of his death. Further there is no eye witness of the occurrence. Petitioner has been in custody since 29.11.2016. Learned counsel for the State opposed the prayer for bail and submitted that the informant has seen the petitioner fleeing

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

Learned District Judge, Jamui, is directed to see that the case is committed to the court of sessions and after commitment the trial court is directed to expedite the trial and try to conclude it within a period of one year.
