JUSTICE AMARESH KUMAR LAL ORAL ORDER 28-01-2015 Heard the learned counsel for the petitioner and the State. No one appears on behalf of the opposite party no.2 even after service of notice.
It appears that vide order dated 14.07.2014, the petitioner was granted provisional anticipatory bail. Considering the facts and circumstances of the case, the provisional bail granted to the petitioner by order dated 14.07.2014 is hereby confirmed. The petitioner above-named will remain on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each within four weeks to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in Bagaha Mahila P.S. Case No. 53 of
Patna High Court Cr.Misc. No.29358 of 2014 (3) dt.28-01-2015 2/2 2013 subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure and the other following conditions :
1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
