2. The petitioner seeks bail in connection with Pirpanhti (Bakharpur) P.S. Case No. 322 of 2023 registered for the offence punishable under Sections 366A, 504 and 506/34 of the Indian Penal Code and Section 4 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case.

5. The victim in her statement made under Section 164 Cr. P.C. has said that she was in a relationship with the petitioner. The petitioner is in jail since 16.12.2023.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive SPL Judge (POCSO)-cum-7th Additional District & Sessions Judge, Bhagalpur/ concerned Court in connection with Pirpainti (Bakharpur) P.S. Case No. 322 of 2023.
