JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Jagdishpur P.S. Case No. 98 of 2017 for the offence under section 395 of the Indian Penal Code.
The case was registered against unknown. The name of the petitioner surfaced on the confessional statement of the coaccused. There is statement on affidavit in paragraph-3 that petitioner has no criminal antecedent.
In paragraph-7 of the petition, it is mentioned that the petitioner has not been put on the Test Identification Parade. Considering the fact that the petitioner has no criminal antecedent and the case was registered against unknown
Patna High Court Cr.Misc. No.36017 of 2017 (2) dt.10-08-2017 2/2 yet he has not been put on TIP and the court below has granted bail to other co-accused.
In the peculiar facts and circumstances discussed above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur P.S. Case No. 98 of 2017 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper the evidence or the witnesses.
