This application, for grant of anticipatory bail, arises out of Sonepur Police Station Case No. 209 of 2016, disclosing offences under Sections 147, 148, 149, 341, 323, 354, 337 of the Indian Penal Code.
Patna High Court CR. MISC. No.15912 of 2019(2) dt.14-03-2019 2/3 Learned Counsel appearing on behalf of the petitioners has submitted that allegation against all the 21 persons, named in the First Information Report, is general and omnibus, except co-accused Jitrendra Rai, against whom there is allegation of disrobing the informant's daughter. It has been argued that land dispute between the parties is apparent from the allegation made in the First Information Report. On perusal of the First Information Report, I find substance in the submissions so advanced on behalf of the petitioners.
This application is, accordingly, allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Saran, at Chapra, in connection with Sonepur Police Station Case No. 209 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
