The petitioners apprehend their arrest in Bhorey P.S. Case No. 04 of 2016, registered for the offences punishable under Sections 420, 406, 467, 468, 471, 323, 120(B) of the Indian Penal Code.
The informant filed complaint petition on the basis of which present FIR is lodged. The informant alleged that Rajesh Ram, petitioner no. 1 requested her to purchase his land and on such the informant gave Rs. 5,10,000/-. Rajesh Ram also executed the deed of agreement to sale with regard to Plot No. 1371, Khata No. 85 situated in Ward No. 23, Gopalganj. When the informant went to construct house the people residing in the neighbours
Patna High Court Cr.Misc. No.20813 of 2016 (2) dt.20-05-2016 2/2 objected construction of house. The informant informed the petitioners and the petitioners did not help her. It is submitted that the sale deed is not under challenge. The informant did not allege any fraud committed by the petitioners. The petitioners are not bound to help the informant in construction.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Bhorey P.S. Case No. 04 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
