The petitioner is accused in connection with Baikunthpur P.S. Case No. 170 of 2017 registered under section 25(1-b)a/26 of the Arms Act pending in the Court of Judicial Magistrate, 1st Class, Gopalganj.
Submission of learned counsel for the petitioner is that petitioner is quite innocent and has committed no offence as alleged in the First Information Report. Petitioner has no concern with the Naxalite.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner is named in the First Information Report and witnesses have also supported the version of the prosecution.
Patna High Court Cr.Misc. No.42823 of 2018(2) dt.19-07-2018 2/2 Petitioner is also accused in several cases.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
However, petitioner is directed to renew his prayer for bail after framing of charge.
