The present application has been filed for quashing the order dated 27.02.2015 passed by learned Special Judge, Muzaffarpur in connection with Sakra P.S. Case No. 155 of 2011 by which cognizance has been taken against the petitioner for offence under Section 379 of Indian Penal Code and 135, 140 of the Indian Electricity Act 2003.

Considering the materials available on record, no ground for quashing of the order dated 27.02.2015 taking cognizance against the petitioner for offence under Section 379

Patna High Court CR. MISC. No.25785 of 2015(2) dt.14-02-2023 2/2 of Indian Penal Code and Sections 135, 140 of the Indian Electricity Act 2003 is made out.

Learned counsel for the petitioner prays for and is permitted to withdraw this application to raise all his grievances at the stage of framing of charge, if the charge has not already framed.

Accordingly, this application is dismissed as withdrawn.
