Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 30.1.2017 passed in Cr.

Misc.No.51599 of 2016.

Submission of the learned counsel for the petitioner is that the petitioner was not having with rod though there is allegation that he assaulted by rod, however, the earlier prayer for bail of the petitioner was rejected on merit, I am not inclined to interfere with the earlier order, however considering the fact that the petitioner is in custody since long and the charge has been framed, the learned trial court is directed to expedite the trial and try to conclude within a period of nine months. At the same time, the S.P., Madhepura is directed to

Patna High Court Cr.Misc. No.47444 of 2017 (2) dt.11-10-2017 2/2 ensure presence of the witness in the court so that the trial maybe concluded within the period as specified as the petitioner is in custody for more than seven months.

With the above observation, this application is dismissed.
