The petitioner is languishing in custody since 13.2.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is to the effect that the informant being S.I., received a secret information about trafficking of liquor on large scale and laid a raid on the house of co-accused Surendra Singh and found all the FIR named accused persons transporting liquor by unloading the same from a truck and loading it on small vehicles and thereafter, 8510 litres of Indian Made Foreign Liquor were recovered. Patna High Court CR. MISC. No.16204 of 2019(2) dt.15-03-2019 2/2 been granted bail by a Co-ordinate Bench of this court vide order dated 4.1.2019 and 17.1.2019 passed in Cr. Misc. Nos. 77942 of 2018 and Cr. Misc. No. 14898 of 2019. It is further submitted that other co-accused Sunil Upadhyay has been granted bail by Co-ordinate Bench of this Court vide order passed on 17.1.2019 in Cr. Misc. Nos. 2333 of 2019. It is further submitted that the petitioner is accused in one other case. Learned APP submits that the petitioner is known as liquor trfficker.
Considering the fact that the persons from whose possession liquor was recovered and the owner of the alleged vehicles from which recovery was made, have been granted bail and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Buxar in connection with Nawanagar (Sonversa) P.S.
