JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 11-02-2019 Writ petition has been filed with a prayer that a direction be issued commanding the respondents to appoint the petitioners as constable against the remaining vacancies of Advertisements no. 01/2004 and 19/2008/2004. A vague assertion has been made that the petitioners have cleared the physical test and were empanelled in the merit list. Such assertion has been made in the prayer of the writ petition. In the entire pleadings no copies of any admit card or any chit of papers has been brought on record to show that the petitioners had ever participated in the process for selection of constables under Advertisement no. 1 of 2004 and 19 of 2008/2004. The petitioners have not made out any case as there is no pleadings to substantiate the petitioners claim based on any details of their application or otherwise. Apart

Patna High Court CWJC No.11703 of 2014 dt.11-02-2019 2/2 from insufficiency of pleadings, this Court would observe that the respondent State in the counter affidavit has placed on record the fact that several merit list were published for recruitment of constable and that pursuant thereto the process has closed and no vacancies are left in Shahabad Range Recruitment Board, from where the petitioners have allegedly applied. The writ petition has also been filed belatedly. For the reasons indicated herein above, the writ petition is devoid of merit and the same is dismissed.
