1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Complaint Case No. 387 / 2016 dated 23.02.2016 registered under Sections 498(A) of the I.P.C.
3. As per the allegation made in the complaint the marriage of the complainant was solemnized with the petitioner on 15.09.2014 in Kali Mandir, Katihar. After marriage the complainant went to her matrimonial home but the family members of the petitioner did not accept this marriage. They started torturing the complainant physically and mentally and ousted her from her the matrimonial home. Subsequently thereafter the husband of the complainant took her to Delhi and
Patna High Court CR. MISC. No.15812 of 2025(7) dt.15-11-2025 2/3 kept her in a hotel and fled away from there. One child was born out of the wedlock between the complainant and the petitioner.
4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged. The petitioner has not demanded any dowry and the allegation of torture against him is false and concocted. The petitioner had performed love marriage with the complainant and due to some difference the present complaint has been lodged.
5. Notice was issued to the opposite party no. 2 but despite service of notice no body has appeared.
6. Regard being had to the submission made by the parties, taking into consideration the fact that allegation is general and omnibus in nature and after service of notice the opposite party no. 2 chose not to appear before this court, accordingly, I am inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Katihar in connection with Complaint Case No. 387 of 2016 subject to the condition
