The petitioner is in judicial custody in connection with Sessions Trial No. 782 of 2021 arising out of Salimpur PS Case No. 320 of 2020 under section 341, 323, 504, 506, 354, 307, 34 of the Indian Penal Code and section 27 of the Arms Act.

The allegation in the FIR is that the petitioner exhorted the accused persons to kill the lady whereafter it is alleged that accused Vikki Singh opened fire twice hitting the back of the informant. Whereafter, the accused persons left the place but not before threatening her that her husband would be killed.

Learned counsel for the petitioner submits that even

He further submits that the person against whom the allegation of opening firing and injuring the informant is concerned, Vikki Singh has since been released on bail in Cr. Misc. No. 6363 of 2022 on 25.5.2022 by a coordinate bench of this Court. Let the order be kept on record. Taking into account the fact that main allegation is against Vikki Singh, the petitioner is order giver, is in custody since 21.11.2021 (as stated in para-12 of the bail application), charge-sheet stands submitted, let the petitioner be released on bail on furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of like amount each to the satisfaction of learned Additional District and Sessions Judge-V, Barh, Patna, in connection with Sessions Trial No. 782 of 2021 arising out of Salimpur P.S. Case No. 320 of 2020 subject to the following conditions:

(i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of

(iii) he shall appear before the concerned police station every fortnight for next six months to mark his presence;

(iv) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
