Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Special Case No. 7445 of 2021 arising out of Gardanibagh P.S. Case No. 443 of 2021 registered for the offence under Section 30(a), 36 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.01.2023 and there is a recovery of 83.5 liters of illicit liquor.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery

Patna High Court CR. MISC. No.16643 of 2023(2) dt.10-05-2023 2/2 of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Patna in connection with Special Case No. 7445 of 2021 arising out of Gardanibagh P.S. Case No. 443 of 2021.
