JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is apprehending his arrest in connection with Shastri Nagar PS case No. 371/2014 for the offence under section 498A of the Indian Penal Code and section3/4 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that informant was married to petitioner in the year 2009 and at that time Rs. 10 lac was spent as dowry, gift and expenses. After some the petitioner started demanding Rs. 20 lac from her father for starting a new business as he had left his job. In the month of October, 2009 the informant was went to Dhanbad along with petitioner and in drunken state the petitioner come to her father and demanded Rs. 20 lac. The demand and torture continued till 24.06.2014 and

Patna High Court Cr.Misc. No.23622 of 2015 (2) dt.06-07-2015 2/2 having found no alternative, the informant filed the present case. It is submitted on behalf of the petitioner that petitioner is ready to keep the complainant with all respect and dignity but the same is not acceptable to the complainant. It is further submitted that petitioner is ready to deposit an amount of Rs. 2000/- each month in the court below which shall be released in favour of the complainant.

Considering the aforesaid facts, it is directed that petitioner shall deposit a sum of Rs. 2000/- each month in the court below which shall be released in favour of the complainant. With the said condition, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Shastri Nagar PS case No. 371/2014, subject to condition as laid down under section 438(2) of the Cr. P.C.
