At the outset, learned counsel for the petitioners has submitted petitioner no.2 is Nanad of the informant and the police have submitted the final form against her, as such he seeks permission to withdraw this application as against petitioner no.2.

In view of the aforesaid submission, the application is dismissed as withdrawn as against petitioner no.2. Petitioner no.1 apprehends her arrest for the offences alleged under Sections 498A, 323 and 379/34 of the Indian Penal Code, registered in connection with Beur P.S.Case No. 482 of 2021.

It has been submitted that petitioner no.1 never

Patna High Court CR. MISC. No.16995 of 2022(2) dt.25-08-2022 2/2 demanded any kind of dowry nor she committed any act which resulted in miscarriage of pregnancy of the informant. As a matter of fact, the real dispute is between the husband and wife and the petitioner has no concern with it. The husband Sonu Kumar has also filed a divorce case being Divorce Case No. 1087 of 2021.

Considering the above facts and circumstances, let petitioner no.1, above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Beur P.S.Case No. 482 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all the defects are removed by the petitioners within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
