2. In this case, the petitioner is seeking regular bail in connection with Forbesganj P.S. Case No. 91 of 2018, registered for the offences punishable under Sections 21(b) and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. As per allegation, 960 bottles of codeine containing 100 ml each was recovered from a bus. The driver was arrested and he disclosed that he was handed over the consignment to deliver it to one Guddu resident of Bochi. The cleaner who was also arrested could not disclose any information relating to the seized contraband.

4. Learned counsel for the petitioner has submitted that the driver from whose possession the contraband was recovered has been granted bail by the Court below itself. The petitioner is not

Patna High Court CR. MISC. No.22057 of 2024(3) dt.04-07-2024 2/2 named in the FIR. Nothing was recovered from his possession and he is a person of clean antecedent. His name is Kamrujjama @ Guddu and he is resident of Bansbari village whereas the consignment was to be delivered to Guddu who is resident of Bochi village.

Considering the above-mentioned facts and circumstances and also considering that the person from whose possession the contraband was recovered has been granted bail by the learned court below itself, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned court below, Araria in connection with Forbesganj P.S. Case No. 91 of 2018, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
