Both the cases arise out of the same police station case and as such both are being disposed of by passing this common order.
These are the applications for anticipatory bail for the
Patna High Court Cr.Misc. No.29566 of 2014 (3) dt.13-01-2015 2/3 offence punishable under sections 304 (B), 120 B and 201/34 of the I.P.C.
Allegedly the sister of the informant was married six years ago and was tortured due to non fulfillment of demand of dowry by way of two wheelers and one bhar gold and ultimately she was done to death and her dead body was also cremated. Submission is that the petitioners are father-in-law and Dever in Cr. Misc. No. 29566 of 2014 and mother-in-law in Cr. Misc. No. 29603 of 2014. The complainant after knowing the truth has filed a petition in the court of C.J.M. Darbhanga stating therein that under misconception and confusion the case has been filed and as a matter of fact the petitioners and others are innocent as his sister died natural death.
The learned A.P.P. submits that the petitioners are relatives of husband of the deceased.
Considering the facts that the complainant has filed a petition dated 23.01.2014 in the court of C.J.M. Darbhanga and as such the above named petitioners in both the cases in case of their arrest or surrender within a period of two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M.
