JUSTICE MADHURESH PRASAD ORAL ORDER 25-02-2019 Petitioner has approached this Court because his claim for nomination of one Saira Begum, his second wife upon demise of his earlier wife Zinat Khanam on 22.05.2010, is not being acceded to by the respondent authorities. The application for nomination of Saira Begum has been submitted on 04.03.2013 before the Branch Manager, State Bank of India, Kaimur, Bhabua.

Counsel for the Bank is also present. He submits that the petitioner may be required to fulfill some legal requirements for nomination of the second wife in place of the earlier wife. Whatever is legally required as per the existing

Patna High Court CWJC No.12057 of 2014(2) dt.25-02-2019 2/2 decisions of the Bank or State Government in this regard should be done and the matter should not be kept pending. In view of the aforesaid observation, this Court would direct the respondent no. 4 to take a decision on the petitioner's representation Annexure 4 after observing all legal requirements. Petitioner also would be obliged to co-operate with the respondent authorities so as to facilitate redressal of his grievance as prayed in the writ petition. Let the entire exercise be completed and the order be passed by the respondent no. 4 within a period of four months from the date of receipt/production of a copy of this order.

Writ petition is disposed off.
