The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
The prosecution case is that in the background of dispute with regard to the blockade of the passage petitioner no. 3 Krishna Bhagat inflicted Farsa blow on the head of the informant as a result she received cut injury on the head. When the informant raised alarm her son came to rescue then the
Patna High Court Cr.Misc. No.20511 of 2016 (2) dt.12-05-2016 2/3 accused persons assaulted him and her grand son. It is submitted by learned counsel for the petitioners that the petitioners are agnates of the informant and specific accusation of assault is only against petitioner no. 3. The injury report of the informant suggests that the informant has received lacerated wound on the scalp and left side of the face, but both the injuries have been found to be simple in nature caused by hard and blunt substance. There is a counter version of the occurrence and petitioners' side have also received injuries. A statement has been made in paragraph 3 of the petition that the petitioner have no criminal antecedent. It is submitted by learned counsel for the petitioners that there is specific accusation against petitioner no.
3 to have made assault with Farsa to the informant. Considering the genesis of the occurrence and the accusation being not corroborated with the medical opinion, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.
