JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-06-2023 The present writ petition has been filed seeking the following reliefs:- "(1) For quashing of letter dt. 01.02.2012 issued by the Chief Manager, Punjab National Bank, Circle Office, Biharsharif only to the extent that the petitioner has been offered notional seniority w.e.f. 01.01.2011 while granting promotion in Junior Management Grade Scale: I (JMGS-I) w.e.f. 01.01.2011 and consequently for granting notional seniority to the petitioner in Junior Management Grade Scale- I (JMGS-I) at par with the candidates of the panel of Selectivity Channel 2008 in place of 01.11.2011 or at least

(II) Further for a direction to the RespondentBank that for all subsequent promotions of the petitioner his seniority in JMGS-I be considered at par with the candidates of the panel of Selectivity Channel 2008 or at least from the date the juniors of the panel have been granted."

At the outset, the learned counsel for the parties jointly submit that the judgment rendered by the learned Single Judge dated 19.05.2010, passed in CWJC No.10424 of 2009, as upheld by the learned Division Bench vide order dated 07.02.2011, passed in LPA No. 151 of 2011, clearly holds that since the effect of punishment imposed upon the petitioner, vide order dated 31.12.2008, shall be over with effect from 01.01.2011, the case of the promotion of the petitioner is required to be considered with effect from 01.01.2011, nonetheless, though the respondent-Bank has given notional promotion to the petitioner in the Junior Management Grade Scale-I, with effect from 01.01.2011, however, the actual monetary benefits have not been granted w.e.f. 01.01.2011. The learned counsel for the respondent-Bank submits the order dated 19.05.2010, passed by the learned Single Judge in CWJC No.

Patna High Court CWJC No.22379 of 2013(2) dt.22-06-2023 3/3 10424 of 2009, as affirmed by the learned Division Bench vide judgment dated 07.02.2011, would definitely be given effect to and the petitioner would be given actual consequential benefits with effect from 01.01.2011. It is directed accordingly. Accordingly, the present writ petition stands disposed off on the aforesaid terms.
