Petitioner apprehends his arrest in connection with Basantpur P. S. case no. 256/2014 registered under sections 420, 467, 468, 471 and 472/34 of the Indian Penal Code. The petitioner was posted as Panchayat Secretary and on the direction of this court, enquiry team was constituted for making enquiry in respect of interpolation in merit list on appointment of the teachers. The enquiry team found petitioner and some others guilty of the above stated act and on the basis of enquiry report, present case was registered.
From perusal of the impugned order of the learned Sessions Judge, I find that learned Sessions Judge, himself, doubted about genuiness of the enquiry report which is the basis of first information report.
Accordingly, it is ordered that in the event of arrest/
Patna High Court Cr.Misc. No.24908 of 2015 (3) dt.17-07-2015 surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S. Agnihotri, Judicial Magistrate, Ist Class, Siwan/concerned court in Basantpur P. S. case no. 256/2014 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
