JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 307, 323, 324, 325, 341, 504 and 506/34 of the Indian Penal Code.

Allegation against the accused persons including the petitioner is of assaulting the son of the informant, due to which he sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.7.2017. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The injuries are said to be simple in nature. No offence under

Patna High Court Cr.Misc. No.42545 of 2017(2) dt.20-09-2017 2/2 Section 307 I.P.C. is made out.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran at Motihari in connection with Kesaria P.S. case No.198 of 2017.
